On Monday, Judge Aileen Cannon released a blistering order that rebuked Jack Smith for his use of an out-of-district grand jury to investigate President Trump.
The grand jury in question had been empaneled in Miami to indict Trump on 37 federal counts in June, as well as three additional charges which were brought against him last month.
It was widely believed that Smith had only been using the grand jury in Washington DC to investigate Trump’s classified documents case.
This decision to move unexpectedly and without explanation to another district has raised several questions about the legitimacy and legality of the proceedings.
Walt Nauta, a Mar-a-Lago aide, was also indicted as a co-conspirator alongside Trump during this investigation into security footage deletion from the property.
Judge Cannon demanded an explanation from Smith regarding “the legal propriety” of such actions, citing her concern over potential abuse of power or violation of law within his investigation process.

She also voiced her frustration at being left out of the loop until after all decisions had already been made and firmly expressed her belief that no similar occurrences should happen again without her knowledge or consent.
“Among other topics as raised in the Motion, the response shall address the legal propriety of using an out-of-district grand jury proceeding to continue to investigate and/or to seek post-indictment hearings matters pertinent to the instant indicted matter in this district,” Judge Cannon wrote referring to the DC grand jury.
The implications behind Judge Cannon’s order are clear: she is determined not to allow any further cases to be taken up by a grand jury outside their designated district unless they have provided sufficient evidence for their reasoning beforehand.
Judge Cannon has taken a firm stance against Jack Smith’s efforts to keep secrets in the courtroom, going so far as to deny Smith’s motion to keep a list of 84 potential witnesses under seal.
The judge said that Smith failed to explain why it was necessary for him to keep the names of these witnesses a secret.
This is not the only instance where Judge Cannon has put Jack Smith’s requests on hold; he also denied Smith’s request to speed up the sharing of classified documents between Trump and his alleged co-conspirator, Walt Nauta.

IF Justice is served it will be “independent” Jack Smith who will wind up in prison.
